News: Class action planned for Xbox bans

Law firm AbingtonIP is encouraging users who have had their Xbox 360s banned from Xbox Live to contact them in anticipation of a class lawsuit.

As discovered by website IncGamers the firm, which specialises in consumer class actions, has set up a form on its website for anyone who was banned from Xbox Live for owning a modified console. The recent actions by Microsoft to remove such users is rumoured to have affected up to 1 million people.

"Although modification of Xbox consoles is arguably against the terms of use for Xbox/Xbox Live, Microsoft 'conveniently' timed the Xbox console ban to coincide with the release of the new Call of Duty: Modern Warfare 2 game and less than two months after the release of the very popular Halo 3: ODST game," reads the text of the AbingtonIP website.

News: The Producers pulls out of Trilogy alliance

Mastertronic's videogames logistics company, The Producers, has announced that it has pulled out of a strategic alliance with distribution firm Trilogy - a deal which was only signed a few weeks ago.

In a brief statement to GamesIndustry.biz Mastertronic chairman Andy Payne said of the move: "We're announcing that The Producers, which is part of the Mastertronic Group, is withdrawing from the strategic alliance with Trilogy and cutting all ties."

Trilogy lists, among the publishers it works with, Square Enix, Ubisoft and 505 Games, and is thought to be the third largest entertainment distributor in the UK.

News: Microsoft plans free Live weekends

Xbox 360 owners with Xbox Live Silver membership will be granted free access to all Gold member features from November 25 to November 30 in Europe, as Microsoft continues to promote the service's new features.

A similar promotion is planned for all other Xbox Live regions between November 20 and 23 according to comments made by Xbox Live director of programming Larry Hryb on his Major Nelson blog.

The offers have been extended in the wake of a suite of new features and application for Xbox Live, giving Silver members (who do not pay a subscription fee and usually only have access to store features) the chance to use online multiplayer, Facebook, Twitter, Last.FM, Netflix, Sky Player, Halo Waypoint and 1 v 100.

Article: Sony to launch online content distribution service in 2010

Sony has confirmed that the planned content distribution service for its network-connected devices will be launched next year.

The online service is expected to offer films, music, books and other content to its range of network-capable TVs, Blu-ray players, ebooks and other devices in a bid to add value to its products, reports Reuters.

Additionally, Sony executive VP Kazuo Hirai told reporters in Japan he is confident sales of the PlayStation 3 will hit the company's official target of 13 million units in the fiscal year ending March 2010.

News: PSP still ahead in Japanese hardware charts

The PSP has retained its lead at the top of the weekly Japanese hardware sales charts, although sales were down over 2,500 units from the previous week to 45,197 (including 6,427 for the PSPgo).

Mirroring a slow week of software sales, all hardware formats saw a drop except for the PSP 3000, for which sales increased by 5,000 units. PSPgo demand though more than halved from the previous week, lowering the overall figure.

Combined Nintendo DS sales were 38,785 (including 5,036 for the DS Lite), down around 4,000 units on the previous week. PlayStation 3 sales were down by 10,000 units to a new total of 38,498. Wii sales fell by even more, down 11,000 units to 26,764.

News: GES Europe makes call for papers

The first Game Education Summit Europe will take place at the Danish Academy of Digital Interactive Entertainment (DADIU) in Copenhagen, according to event organisers Game Path.

The summit is scheduled for June 22-23, 2010 and aims to bring together academics from universities and art schools, along with policymakers and industry professionals, to discuss the state of game education in Europe.

Registration for the event will begin in January, but in the meantime Game Path has made a call for papers. Proposals for presentations are sought on the following subjects:

News: GCHQ runs ad campaign in Xbox Live

The UK government intelligence agency in charge of signals analysis and information for the country's armed forces, GCHQ (Government Communications Headquarters), is to promote various career opportunities within the organisation on Microsoft's Xbox Live service.

The campaign will be run by GCHQ's marketing agency, TMP Worldwide, and will run for six weeks targeting 18-34 year olds, according to Marketing.

GCHQ is no stranger to using videogames as a medium for getting its career opportunities message out to people, with a similar in-game campaign run in 2007 with Ubisoft's Splinter Cell title increasing traffic to its website by over 500 per cent.

News: Dark Void film optioned by Brad Pitt

Brad Pitt's production company Plan B Entertainment, together with the Indian-owned Reliance BIG Entertainment, have acquired the film right to Capcom title Dark Void.

The film adaptation is already being touted as a possible starring vehicle for Pitt himself, although no time frame for the production has been made public.

The game is due to be released on January 22 in Europe (January 19 in North America) for the Xbox 360, PlayStation 3 and PC. The title is being developed by Airtight Games, staffed by several former members of FASA Studio who worked on original Xbox title Crimson Skies.

News: PS2 officially hits Brazil

Brazil, an emerging market for the videogames industry, has finally seen the official launch of Sony's PlayStation 2 in the country.

However, with a price point of BRL 799 (USD 462) it's not clear quite how much impact the console will be able to have on a market that's considered to have a high threat from piracy.

It's expected that games will cost BRL 119 (USD 69) for new releases and BRL 99 (USD 57) for catalogue titles, with 14 games available at launch - including Gran Turismo 4 and God of War II.

News: 90+ venues planned for Global Game Jam 2010

The 2010 Global Game Jam event will take part in more than 90 venues across the world, as organisers IGDA (International Game Developers Association) begin registrations.

The concept involves teams of enthusiasts designing and creating new videogames within a 48 hour period. This year's event saw 1,650 participants from around the world creating 360 different titles.

The next event is due to take place from January 29-31, 2010. Worldwide locations confirmed so far include 38 in the U.S. and seven in the UK (Bristol, Glasgow, London, Luton, Newport, Plymouth and Stafford).

News: Marvelous reaps greater profits from PSP than Wii in 2009

Japanese publisher Marvelous Entertainment has revealed its PSP games have been far more profitable for the company than its Wii releases in 2009.

Of its five PSP releases in the fiscal first half, four have returned profits for the company, it said. However, from its four Wii releases, only one has delivered a return.

Data presented to investors and reported by Siliconera, show that Marvelous's PSP games sold in higher units than its Wii titles. Combined with lower development costs, the games, in turn, delivered profits.

News: Sony studying PSN premium subscription

Sony Computer Entertainment has denied suggestions that it is ready to start charging an Xbox Live-like subscription for the use of the PlayStation Network, underlining that multiplayer functionality, Home and other features currently free would remain so.

But it is looking closely at the idea of adding a new revenue stream into the Network model for premium content and services, according to Kaz Hirai, executive VP and president of the corporation's Networked Products and Services Group.

"SCE will further increase sales by offering users new entertainment through the combination of hardware, software, peripheral and PlayStation Network," he said in a presentation to investors yesterday. "Especially in the online area, we are studying the possibility of introducing a subscription model, offering premium content and services, in addition to the current free services."

News: Dedicated servers for Aliens vs Predator

The PC version of licensed shooter Aliens vs Predator will support dedicated servers, according to a new statement made by British developer Rebellion.

"Despite rumours, Rebellion has always been planning to support dedicated servers for Aliens vs Predator PC and we can now officially confirm that this is the case. Rebellion has always appreciated fan support," said Rebellion CEO Jason Kingsley. "We're really looking forward to the release of Aliens vs Predator as much as you guys are!"

Previously senior producer David Brickley had remained uncommitted on the question, commenting: "You know what the internet's like. We're obviously used to getting things for free over the years. I guess on our side the thing we're focusing on is whatever your set-up at home, you get the best possible experience from it. We're just trying to use our time and resources wisely."

News: Sony's 3D strategy to incorporate PS3

Sony has listed 3D gaming as one of the five key advantages to the PlayStation 3 platform, and confirmed that the release of 3D games onto the console will form part of its 3D strategy in the future.

In a presentation to investors, the company revealed its plan to add 3D capabilities to the PS3. "All PS3 units will be firmware upgradable to 3D", it said.

Offering 3D tools to third party developers in the future will form part of the plan as Sony aims to "lead to the 3D market."

Editorial: The Price Gamble

1.7 million people in the UK bought Modern Warfare 2 last week, a figure almost lost in the controversy which has surrounded this game for months. Amid the raised voices over the controversial airport level, it's almost possible to forget that a few months ago, it wasn't the content of Modern Warfare 2 that concerned us all - it was the price.

In the end, the higher price point which fermented so much debate over the summer meant nothing to consumers. While specialist retailers fumed, some supermarkets discounted the game down to GBP 26 and online giant Amazon dropped its price tag to GBP 32 a few days before launch. Even considering the buying power of such retail giants, it's likely that some outlets were treating the game as a loss leader.

As such, Activision's GBP 10 price hike was mostly absorbed by retailers, not passed on to consumers - a fact which will give publishers pause for thought in the coming weeks. There has always been a fear that if MW2 was not damaged by the higher price point, other publishers would seek to drive their own prices up - in defiance of the obvious decline in most consumers' value perception of all media, games included.

News: Retailers must "make their own decisions" about pricing

Microsoft's Neil Thompson has told GamesIndustry.biz that retailers must choose for themselves the price points they're going to set for the sale of videogames - but has issued a warning about the sustainability of some of the aggressive discounting seen recently for games such as FIFA 10 and - particularly - Modern Warfare 2.

"Retailers have to make their own decisions about how they price in the market," he said this week. "I suppose the challenge when retailers do go aggressive on pricing in the way that some people do: is that sustainable over the long-term both for the industry and for themselves? Retail just have to make their own decisions."

He added that there was also a danger, when the public can pick up key titles on release day for as little as GBP 25, that the issue of value was being distorted.

News: Sega finds goal in Japanese charts

For the second week running a football title sits atop the weekly Japanese sales charts, although Konami's World Soccer Winning Eleven 2010 (aka Pro Evolution Soccer 2010) has been replaced by the first PSP entry in Sega's long-running J-League Pro Soccer Club o Tsukurou! series.

Although only one iteration in the role-playing/management series has ever been released in Europe (as Let's Make a Soccer Team!) the franchise continues to prove popular in Japan. First week sales of just 63,000 are low for a number one title in Japan though and compare poorly to Konami's total of 218,000 last week.

Weekly sales overall were generally low across the board, with new PS3 entry Dragon Ball: Raging Blast at number three selling only 58,000 units. The Xbox 360 version entered the charts at number 28.

News: GameStop earnings up 11% in third quarter

GameStop has reported an 11.8 per cent increase in net earnings for its quarter ending October 31.

Earnings for the period totalled USD 52.2 million compared to USD 46.7 million for the prior quarter, which equated to earnings per share of USD 0.31.

Total company sales also rose to USD 1.83 billion - an increase of 8.2 per cent. Used product sales increased 19.4 per cent on top of the 19.3 per cent increase seen in the third quarter of 2008. New software sales grew 9.4 per cent.

News: Super Mario Bros Wii "off to good start"

Lazard Capital Markets analyst Colin Sebastian has released a new investor note following a meeting with Nintendo yesterday in which he cites the Wii manufacturer as saying that sales of Super Mario Bros Wii are "off to a good start after three days at retail".

However, he adds that it's not yet apparent whether or not the game has "driven incremental hardware sales," a point which he notes "remains a concern for the overall videogame industry."

The meeting also covered Nintendo's ongoing strategy to drive audience expansion by targeting users of all ages and attempting to balance even further the gender split, while Sebastian also noted the launch in Japan of the company's video-on-demand service, Wii-no-Ma.

News: Ubisoft utilises LoveFilm partnership for AC2 marketing push

Ubisoft is to utilise its partnership with LoveFilm for an extensive Assassin's Creed campaign, promoting both the upcoming game sequel and the trilogy of short films.

The campaign marks Ubisoft's fourth with the DVD rental company after the original Assassin's Creed, Rainbow Six Vegas and HAWX.

Promotions will include a run of 350,000 specially branded envelopes, pre-roll trailers and a LoveFilm hosted microsite displaying game related content and exclusive information on the upcoming films.

News: Banned Xboxes flood eBay

Microsoft's recent actions against Xbox Live users with modded consoles has led to an unexpected surge in second-hand sales of the Xbox 360.

Online sites such as Craigslist and eBay show dozens of listings for consoles variously described as "banned", "not modded" or "100% working offline". The average cost for a banned standalone console has settled at around GBP 50 (compared to a retail price of GBP 160 for a new Xbox 360 Arcade).

Earlier in the month Microsoft began a large scale attempt to ban modded consoles, many of which could be used to play pirated software, from Xbox Live. The bans remove the console's ability to go online but leave it still able to function offline.

News: NeoEdge merges with Offspring

NeoEdge Networks is to merge with Offspring as the two casual games developers seek to expand their products onto new platforms and create new digital intellectual properties.

Offspring was founded by former Pogo.com executives Lesley Mansford, Andrew Pedersen, Karen Schulman and Todd Heringer. All four left EA after helping to launch what is now one of the number one online casual games portals.

Mansford will now become the combined company's new CEO, with Pedersen, Schulman and Heringer all assuming senior vice president roles - along with NeoEdge's Dan Servos.

Middleware developer NaturalMotion has appointed a local territory manager in South Korea, as the company looks to expand the market for its morpheme and euphoria technology.

Former business development manager Mag KW Kim will head the new office and act as the direct point of contact for all developers in the region. She will also represent the company at the upcoming G-Star 2009 event in Busan, South Korea.

"Through innovative design and development, the Korean games industry has become a major player on the international scene", said Andy Payne, NaturalMotion's vice president of sales.

News: Report: Unnamed third studio working on Call Of Duty franchise

Activision has a third development studio working on a new Call of Duty title, according to a report by the Los Angeles Times.

In a feature focused on the recent record-breaking sales of Call of Duty: Modern Warfare 2, which grossed USD 550 million in five days, the newspaper makes brief mention of a third studio "working on future versions."

Traditionally, series creator Infinity Ward has produced the most high profile releases in the franchise, including the two Modern Warfare games, with Treyarch filling in on alternate years with titles such as Call of Duty: World at War.
